LEWISTON (WGME) -- A popular spot for ATV riders in Lewiston is closed for good.
All Wheels Off Road Recreation Park lost its appeal Wednesday night.
They were fighting a city decision to shut down the park, because they didn't have the proper permits.
The owner, Don Arel, had been letting the public use the park for riding, a shooting range, and camping only asking for donations to use the park but the city says he can't do that without going through the planning board.
Arel says: Im kinda at a loss for words that they want to take away recreation. The state wants open recreation land. I've allowed people to play on my land, but now the city is telling me I can't do this because Im operating a business, because I asked for donations? I never forced anybody to pay.
Gil Arsenault, Planning and Code Enforcement Director, says: It really had nothing to do with is it a business, is it not a business. It's a land use and it's use, even though it's still a large track of land, it's still a single family home.
Arel says he won't appeal the decision, and is now deciding whether to sell his land.
