A judge ruled that Goose Rocks Beach can remain open to the public. A storm has certainly been brewing between town hall and people who own beach front property here. Property owners say they never wanted to kick the public off this popular beach, but they started to get frustrated as the beach became more crowded in recent years.
They're upset that the town started to promote the beach as a tourist destination and expanded parking and walkways. They said the town did all this without caring about what homeowners thought and that forced them to go to court.
A superior court judge ruled in favor of the town though, saying the public has used the beach for decades, therefore it should be allowed to continue to use the beach. The town says Goose Rocks Beach is a quiet family friendly place- and they are thrilled with the judge's decision.
Homeowners here say property owners across the state should be nervous after this ruling, saying it sets a precedent that if you let people hunt or fish or use the beach on your land for a certain period of time. A court will allow it continue forever.
Property owners say they will file an appeal. The town says it hopes it can move forward and put this case behind them.
